1.  Scope of the Contract

FairFem sells the goods and provides the services offered in the online shop to consumers (hereinafter referred to as ‘you’ or the ‘customer’) according to the general terms and conditions (T&Cs) listed below.

This website is owned and operated by FairFem, Konstanzerstrasse 42A, 8280 Kreuzlingen, Switzerland.  The contracting party is FairFem.

These Terms set forth the terms and conditions under which you may use our website and services as offered by us.  

​

2.  Binding Terms and Conclusion of the Contract

By placing an order with FairFem, you agree to these T&Cs.  When buying an item (by clicking the button 'Place Order'), you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

 

The contract is deemed valid amongst both parties when FairFem sends an order confirmation to your provided email address.  This will be sent immediately after the order is processed, assuming all provided information is complete and accurate.  Please note that FairFem has the right to reject the order based on insufficient information provided by the buyer, payment processing issues, amongst other circumstances.  An agreement is not entered into until both parties accept the order.

 

The goods remain property of FairFem until full payment is received.

3.  Terms of Pricing and Payment

​

The prices we charge for purchasing our products and services are listed on the website. We reserve the right to change our prices for products and services displayed at any time, and to correct pricing errors that may inadvertently occur.  Prices apply which are listed at the time of an order.

​

The prices are notated in Swiss Francs (CHF) and include the Swiss Value-Added Tax of 7,7%.  Payment is made in advance.  Additional information about payment options is available here.

4.  Terms of Shipping & Delivery

​

All shipments are dispatched by Swiss Post and are only shipped within Switzerland.  For all orders below 150 CHF, shipping is charged at a flat rate of 10 CHF.  For all orders at and above 150 CHF, shipping is free.  Any shipping costs are calculated on the final Check-Out page.

Delivery is not made until payment is received.

​

Items will be shipped in compostable mailers and if a larger purchase, in a recycled cardboard box.  Standard handling and delivery time is 4-10 business days.  In order to reduce our carbon footprint, only one shipment per order is made. Certain brands create the product upon order (which assists with the goal of reducing waste), meaning that the shipment may take a bit longer.  FairFem does not take responsibility for delivery delays when production/shipment delays occur outside of our control (e.g., weather delays, strikes, pandemics, etc) and this does not constitute as a reason for the customer to withdraw from the contract.

5.  Terms of Return and Refunds

​

Any undamaged, unworn, unwashed, and unused product with their original tags and packaging can be returned.
 

To initiate the return process, please send an e-mail to info@fairfem.ch or contact us within 5 business days of receiving the item (based on the delivery date) and note the reason for returning, whether you would like to exchange the item, receive a store credit, or receive a refund.
 

Upon FairFem's confirmation of the return, we will send you a free return label. Return the item(s) with its included accessories and packaging along with the original receipt within 10 business days of confirmation.  Upon receipt of the good(s), we will either exchange it (with shipping costs based on the original method) or offer a refund based upon the original payment method or in the form of a store credit (based on what was agreed in the return confirmation).

-Gift Boxes

-Undergarments (including panties and bras)

-Swimsuits

-Jewelry

-Sale Items

6.  Warranty and Liability of Product Range

​

The customer must check the goods for defects immediately upon receipt and report defects within 5 business days of receipt (based on delivery date) to info@fairfem.ch or via the Contact page.

​

A solution will be presented to the customer and are subjective to the particular case.  Methods of remedy include: replacement of the defect item with a defect-free item of the same sort, elimination of the defect, or partial refund of the item price.  The options presented to the customer will depend on the circumstance and are at the subjection of FairFem.

​

The defected good must be returned as it was delivered to the customer, otherwise FairFem is entitled to the original purchase amount incurred by the customer. The goods must not be damaged/soiled in any way.

​

In the case of a defect item, FairFem will pay for the return shipping costs.

 

FairFem is not liable for transport damage and damage after takeover by the customer or affiliated parties.

Please note that Images of the articles are provided for illustration only and are not binding.  All information on the goods that the customer receives as part of the ordering process is non-binding. Errors in the description, illustration and price are reserved.  When selecting brands, we do our best to select those that meet our sustainability and ethical criteria.  If we choose to support a brand that does not fit into this profile, this will be noted on the Brands page.  If we find out after a purchase that a brand has failed to meet our standards, we will do our best to inform our customers and find a solution, but FairFem does not hold liability for this.

7.  Intellectual Property

​

FairFem reserves all rights for every design, text, and graphic on its website. Copying or any other reproduction of the entire website or parts of this website is prohibited, unless explicit rights are granted.

8.  Terms of Promotions and User Account

​

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with. If you don't want to receive such promotional materials or notices – please just notify us at any time. 

​

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these T&Cs or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.

9.  Indemnification and Limitation of Liability

​

You agree to indemnify and hold FairFem harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the products offered on the website.

To the maximum extent permitted by applicable law, in no event shall FairFem, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

​

To the maximum extent permitted by applicable law, FairFem assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

10.  Place of Jurisdiction and Applicable Law

​

These T&Cs, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced solely and exclusively in accordance with the internal laws of canton Thurgau in Switzerland. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the canton of Thurgau.

11.  Final Provisions

​

When buying the goods specified by FairFem in the online shop, only the T&Cs apply in the version valid at the time of the respective contract conclusion.  Should individual provisions of these T&Cs be or become ineffective, this does not affect the legal validity of the remaining provisions. Instead of the ineffective provision, the statutory provisions apply. In addition, FairFem reserves the right to make changes to these T&Cs including the data protection conditions at any time.
